Welcome to Black Horse Towing LLC ("Black Horse Towing," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your use of our website, your request for our towing and roadside services, and your participation in our SMS messaging program. By accessing our website, requesting a service, or opting into our messaging program, you agree to these Terms. If you do not agree, please do not use our services.
1. Age Restriction
By using this website or requesting our services, you represent that you are at least 18 years of age. Our services and website are not directed at individuals under 18.
2. Services We Provide
Black Horse Towing provides local light-duty towing and roadside assistance services in the Southwest and South Houston, Texas area, generally within a 50-mile radius of our operating base. Our services include, but are not limited to:
- Light-duty towing of passenger vehicles, pickups, and light trucks
- Low-clearance vehicle towing (lowered, sports, and exotic vehicles)
- Roadside assistance: jumpstarts, tire changes, lockouts, and fuel delivery
- Accident recovery
- Winch-out recovery for vehicles stuck off-road or in ditches
We operate daily from approximately 6:00 AM to 10:00 PM Central Time. We do not offer heavy-duty commercial towing, long-distance auto transport, or 24-hour overnight dispatch.
Black Horse Towing is licensed by the Texas Department of Licensing and Regulation (TDLR License #006630991C) and carries commercial towing insurance.
3. Service Requests, Pricing, and Payment
Requesting service. You may request service by calling us at (346) 537-1234 or by submitting a request through our website. A request is not a confirmed booking until we verbally confirm dispatch and provide an estimated time of arrival.
Pricing. Final pricing depends on the type of service, distance, vehicle condition, and any additional equipment or labor required. We provide a good-faith quote at the time of dispatch. Circumstances discovered on arrival (for example, a vehicle that is more severely damaged or differently located than described) may require a revised quote, which we will communicate before performing the service.
After-hours and surcharges. Services requested outside our standard hours, on holidays, or under hazardous conditions may carry a surcharge, which we will disclose before dispatch.
Payment. Payment is due at the time of service unless otherwise agreed in writing. We accept major credit and debit cards and cash. Unpaid invoices may accrue reasonable late fees and, where legally permitted, may be pursued through collection.
4. Customer Representations
By requesting our services, you represent and warrant that:
- You are the owner of the vehicle, or you are authorized by the owner to request towing or roadside services for it;
- You have the legal right to have the vehicle moved from its current location;
- You have accurately described the vehicle's make, model, condition, and any modifications (for example, if the vehicle is lowered, damaged, or non-running);
- You will be present at the pickup location or will authorize an agent to meet our driver and release the vehicle;
- Any information you provide (including the pickup and drop-off addresses) is true and correct.
If any of these representations turns out to be materially inaccurate, we reserve the right to decline or stop the service, and you may be responsible for a dispatch or callout fee.
5. Cancellations, No-Shows, and Dispatch Fees
Cancellations before dispatch. You may cancel a service request at no charge before a driver has been dispatched.
Cancellations after dispatch. If a driver has already been dispatched when you cancel, a dispatch fee may apply to cover time and fuel. We will disclose any applicable fee at the time of cancellation.
No-shows. If we arrive at the confirmed pickup location and you, the vehicle, or an authorized representative cannot be located within a reasonable wait period, a callout fee may apply.
6. Vehicle Inspection and Condition
Our driver may conduct a brief visual inspection of your vehicle before towing. We encourage you to identify any pre-existing damage to our driver at that time. Our driver may photograph the vehicle before and after the tow for documentation.
You acknowledge that vehicles with unusual conditions — low ground clearance, aftermarket modifications, mechanical issues, or locked wheels — may require special handling. You agree to disclose these conditions when requesting service so we can dispatch the appropriate equipment.
7. Limitation of Liability
We will perform all services with reasonable care and in accordance with industry standards. However, to the fullest extent permitted by Texas law:
- Black Horse Towing is not liable for (a) damage caused by pre-existing mechanical, structural, or electrical conditions; (b) damage that is a direct result of undisclosed vehicle modifications or misrepresented vehicle condition; (c) loss of personal property left inside the vehicle; (d) acts of third parties, law enforcement, or government agencies; or (e) events beyond our reasonable control (including weather, road conditions, and traffic).
- In no event shall we be liable for indirect, incidental, consequential, punitive, or lost-profits damages.
- Our total liability for any claim arising from a service is limited to the amount you paid for that specific service or to the applicable coverage provided by our commercial towing insurance, whichever is greater.
Any damage claim must be reported to Black Horse Towing in writing, with photos, within 72 hours of the service.
8. Storage of Vehicles
We are not a permanent storage yard. If circumstances require us to temporarily hold a vehicle, storage will follow applicable Texas Occupations Code and TDLR rules for non-consent and consent tow storage. Storage fees, if any, will be disclosed when the vehicle is placed in storage. Unclaimed vehicles may be disposed of in accordance with Texas law.
9. SMS and Mobile Messaging Program
By providing your mobile number and opting in through our website, phone intake, or written authorization, you agree to receive SMS text messages from Black Horse Towing LLC related to your service request. These may include automated and non-automated messages.
- Program purpose and use cases. We use SMS to send dispatch confirmations, driver ETA updates, arrival notifications, invoice receipts, follow-up messages regarding service, and — only if you have explicitly opted in — occasional promotional offers.
- Consent. Consent to receive SMS is not a condition of receiving our services. You may still request and receive service by telephone or email without opting into SMS.
- Opt-out. You can cancel the SMS service at any time by texting STOP to our messaging number. After you send STOP, we will send you a single message confirming that you have been unsubscribed, and we will not send further SMS messages unless you opt in again.
- Help. For assistance with the messaging program, text HELP to our messaging number, or contact us at info@blackhorsetowingusa.com or (346) 537-1234.
- Message frequency. Message frequency varies based on your service request and interaction with us.
- Message and data rates. Message and data rates may apply. Please consult your mobile carrier for details.
- Carrier liability. Wireless carriers are not liable for delayed or undelivered messages.
- Privacy. We do not share, sell, or rent your mobile information or your SMS opt-in consent with third parties for their own marketing purposes. Our use of your data is governed by our Privacy Policy.
10. Privacy
Your use of our website and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
11. Website Use
This website is owned and operated by Black Horse Towing LLC. You may not use this website for any unlawful purpose, to transmit harmful code, or to attempt to gain unauthorized access to our systems. We reserve the right to restrict or terminate access to the website at our discretion.
12. Intellectual Property
All content on this website — including the Black Horse Towing name, logo, text, graphics, and design — is owned by Black Horse Towing LLC or our licensors and is protected by United States copyright and trademark laws. You may not copy, reproduce, or use this content without our prior written permission, except for normal personal use of the website.
13. Changes to These Terms
We may update these Terms from time to time. The current version will always be posted on this page with an updated "Last updated" date. Your continued use of the website or our services after changes are posted constitutes your acceptance of the updated Terms.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or our services shall be resolved exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts.
15. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
